Estate Planning Snapshot

Where do you stand on the basics — and what do you need to check for your state? This is a plain-English starting point, not legal advice. The rules that matter most vary by state, so we point you to the primary sources to verify.

Estate rules vary by state — and change over time.

Probate, intestacy, estate/inheritance tax, and Medicaid estate recovery all differ by state. This is an educational starting point, not legal advice. Confirm anything that matters with a licensed attorney in your state.

The core building blocks

  • A will

Says who gets what and who's in charge. Without one, your state's intestacy rules decide — and they may not match your wishes.

  • Beneficiary designations

Retirement accounts, life insurance, and many bank accounts pass by beneficiary form, not your will. Check that they're current.

  • Durable power of attorney

Lets someone you trust handle finances if you can't. State forms and requirements differ.

  • Healthcare directive / proxy

Names who makes medical decisions for you and records your wishes. Sometimes called a living will or healthcare POA.

  • Guardianship (if you have kids)

Names who'd raise minor children. This is usually done in your will.

  • A trust (sometimes)

Can avoid probate or handle specific situations. Whether it helps you depends heavily on your state and assets — get advice before paying for one.

Check your state

Pick your state and we'll point you to the primary sources to verify the rules that apply to you.

Source guidance last reviewed May 24, 2026. This is educational and not legal, tax, or financial advice. Estate and Medicaid rules vary by state and change — a licensed estate attorney in your state should review any real decision.
